1. Introduction

Welcome to the Benidorm Holiday Pass. These Terms of Service ("Terms") govern your purchase and use of the Benidorm Holiday Pass digital discount card ("Pass"). By purchasing or using the Pass, you agree to be bound by these Terms. If you do not agree, please do not purchase or use the Pass.

The Pass is operated by Benidorm Holiday Pass, located at Calle Xeraco 10, Piso 10, 03509 Finestrat (Alicante), Spain ("we", "us", "our").

2. The Pass

The Benidorm Holiday Pass is a digital discount card that provides access to exclusive deals and discounts at participating venues in and around Benidorm, Spain. The Pass is:

• Valid for 1 (one) year from the date of purchase
• Non-transferable and intended for use by the registered purchaser only
• A digital product delivered instantly via email upon purchase
• Accessible through a unique QR code and online account

3. Purchasing the Pass

To purchase the Pass, you must be at least 18 years old or have parental/guardian consent. All payments are processed securely through Stripe. By completing a purchase, you confirm that:

• The payment information you provide is accurate and you are authorized to use it
• You understand the Pass is a digital product delivered electronically
• You have read and agree to these Terms

4. Using the Pass

Upon purchase, you will receive login credentials to access your Pass. To redeem a deal, present your digital QR code at the participating venue. Please note:

• Deals and discounts are subject to availability and may vary by venue
• Participating venues reserve the right to modify or discontinue their offers
• Some deals may have specific conditions (e.g., minimum spend, time restrictions)
• The Pass cannot be combined with other promotions unless stated otherwise
• You must present the Pass before placing your order or requesting the bill

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share, sell, or transfer your Pass or account to any other person. Any unauthorized use of your account should be reported to us immediately.

6. Intellectual Property

All content on the Benidorm Holiday Pass website and platform, including logos, text, images, and software, is the property of Benidorm Holiday Pass and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Limitation of Liability

Benidorm Holiday Pass acts as an intermediary between you and participating venues. We are not responsible for the quality of goods or services provided by partner venues. Our liability is limited to the purchase price of the Pass.

We do not guarantee the continuous availability of any specific deal or participating venue. Venues may change their operating hours, deals, or participation status without prior notice.

8. Modifications to the Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Pass after any changes constitutes acceptance of the new Terms.

9. Termination

We reserve the right to suspend or terminate your account and access to the Pass if you violate these Terms, engage in fraudulent activity, or misuse the Pass in any way.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain.
